Services
Wide Rivers provides home improvement and construction services, including, but not limited to: windows, doors, roofing, siding, decking, flooring, gutters, fencing, painting, trim/millwork, and related services. All services are subject to availability in your area.
Quotes and Estimates
- All quotes are estimates and subject to change based on actual site conditions, material costs, and scope changes.
- Quotes are valid for 30 days unless otherwise stated in writing.
- Final pricing will be confirmed in a written contract prior to work commencing.
Contracts and Agreements
All projects require a signed contract before work begins. The contract will specify:
- Scope of work
- Materials to be used
- Total price and payment schedule
- Estimated timeline
- Warranty information
The signed contract, together with these Terms & Conditions, constitutes the entire agreement between you and Wide Rivers LLC. Any prior discussions, representations, or agreements not included in the signed contract are superseded.
Payment Terms
- Deposit required upon contract signing (amount specified in contract)
- Progress payments may be required for larger projects
- Final payment due upon project completion
- Accepted payment methods: Check, ACH, Credit Card, Financing (where available)
- Late payments may incur additional fees as specified in your contract
Cancellation Policy
- Cancellations must be made in writing
- Deposits may be non-refundable if materials have been ordered or work has commenced
- Cancellation fees may apply as specified in your contract
- North Carolina Residents: Under North Carolina law (N.C. Gen. Stat. § 25A-39), you have the right to cancel certain home solicitation sales within three (3) business days of signing the contract. This right applies to contracts signed at your residence. See your contract for the Notice of Cancellation form and deadline.
Warranties
- Product warranties are provided by the respective manufacturers
- Workmanship warranties are specified in your contract
- Warranty claims must be submitted in writing
- Warranties do not cover damage caused by misuse, neglect, acts of nature, or unauthorized modifications
Permits and Compliance
- Wide Rivers will obtain necessary permits where required
- Permit fees are the responsibility of the homeowner unless otherwise specified
- All work will comply with applicable local, state, and federal building codes
Property Access and Preparation
- Customer must provide reasonable access to the work area
- Customer is responsible for removing personal items from the work area
- Wide Rivers will take reasonable precautions to protect your property, but is not liable for pre-existing conditions or unavoidable construction impacts
Limitation of Liability
To the fullest extent permitted by law:
- Wide Rivers' liability is limited to the contract value of the services provided
- Wide Rivers is not liable for indirect, incidental, or consequential damages
- Wide Rivers is not liable for delays caused by weather, material shortages, or circumstances beyond our control
Indemnification
You agree to indemnify, defend, and hold harmless Wide Rivers LLC, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your breach of these Terms, misuse of our services, or violation of any third-party rights.
Force Majeure
- Neither party shall be liable for any failure or delay in performing their obligations due to causes beyond their reasonable control, including but not limited to acts of God, natural disasters, severe weather, pandemics, government actions or orders, labor disputes, material shortages, supply chain disruptions, or utility failures. Affected timelines shall be extended by the duration of the delay.
Dispute Resolution
- Any disputes shall first be addressed through good-faith negotiation
- If unresolved, disputes will be submitted to mediation
- Legal proceedings, if necessary, shall be conducted in the state where the work was performed. If mediation does not resolve the dispute within thirty (30) days, the dispute shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Buncombe County, North Carolina. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
